Digital Millennium Copyright Act Policy

ApeFax Holdings LLC ("ApeFax," "we," "us," or "our") respects intellectual-property rights. This Digital Millennium Copyright Act Policy (the "DMCA Policy") explains how to report material available through ApeFax that you believe infringes a U.S. copyright and how a person whose material was removed may submit a counter-notification.

This policy is a notice procedure. It does not determine ownership, infringement, fair use, or any other legal issue, and submitting a notice does not guarantee removal or any other outcome.

This policy applies to material displayed, stored, or controlled through apefax.com, ApeFax Reports, certificate records, application interfaces, and related services.

ApeFax Reports and certificate records are generated by ApeFax from public blockchain data, token identifiers, public trait metadata, marketplace information, and ApeFax analysis. ApeFax certificates are currently database records, not on-chain NFTs. On-chain certificate minting remains closed until the applicable review, deployment, and founder-approval gates are complete.

Reports may display or reference NFT images, collection names, token identifiers, public traits, and other third-party material. A source asset may be delivered from ApeFax infrastructure, a provider, or a token metadata location depending on the feature and current implementation. This policy also applies to user-submitted content if ApeFax enables a feature that accepts such content.

To submit a notification of claimed copyright infringement under 17 U.S.C. Section 512(c)(3), provide the following in writing:

1. a physical or electronic signature of a person authorized to act for the owner of the exclusive right allegedly infringed;
2. identification of the copyrighted work claimed to have been infringed or, for multiple works in one notice, a representative list;
3. identification of the material claimed to be infringing and information reasonably sufficient for ApeFax to locate it, such as a specific URL, page path, Report identifier, certificate identifier, collection, and token identifier;
4. information reasonably sufficient for ApeFax to contact you, including an address, telephone number, and, if available, an email address;
5. a statement that you have a good-faith belief that the complained-of use is not authorized by the copyright owner, its agent, or law; and
6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.

ApeFax may request missing information and may be unable to act on a notice that does not substantially comply with applicable requirements. Consider consulting a lawyer before submitting a notice.

When ApeFax receives a sufficiently complete notice, it may investigate, request clarification, disable access to material, remove material, notify the person associated with the material, or take another action required or permitted by law.

ApeFax may decline to act on a notice that is materially incomplete, appears fraudulent or abusive, contains a material misrepresentation, does not identify material ApeFax can locate, or concerns material outside ApeFax's control. Where appropriate, ApeFax may direct the complainant to the platform or provider that hosts the identified material.

If material you submitted was removed or disabled because of a mistake or misidentification, you may send a counter-notification to the contact in Section 3. A counter-notification should include:

1. your physical or electronic signature;
2. identification of the material removed or disabled and the location where it appeared before removal or disabling;
3. a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification;
4. your name, address, and telephone number; and
5. a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, a judicial district in which ApeFax may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.

Where the DMCA applies, ApeFax may forward a compliant counter-notification to the original complainant and may restore the material no sooner than 10 and no later than 14 business days after receipt unless ApeFax receives notice that the complainant filed an action seeking a court order concerning the material.

In appropriate circumstances and at ApeFax's reasonable discretion, ApeFax may suspend or terminate an account or content-submission privilege associated with repeated copyright infringement. ApeFax may consider the completeness and validity of notices, counter-notifications, court orders, admissions, and other relevant evidence rather than treating every allegation as a final infringement determination.

Knowingly and materially misrepresenting that material is infringing, or that removed material was removed by mistake, may create liability under 17 U.S.C. Section 512(f) or other law. Do not submit false, automated, harassing, or abusive notices.

ApeFax outputs may reference or display an NFT image, collection mark, token identifier, public trait metadata, or blockchain data. ApeFax's report and certificate layout, analysis, and branding do not determine ownership of the underlying collection artwork or marks.

If you believe an ApeFax output infringes your copyrighted work, identify the copyrighted work and the precise ApeFax-controlled material at issue. Include the relevant URL, collection, token identifier, and Report or certificate identifier when available. A complaint about material hosted by a marketplace, metadata server, or another provider may need to be directed to that provider as well.

Collection names and trademarks remain the property of their respective rights holders. ApeFax is not affiliated with, endorsed by, or sponsored by Yuga Labs or any other collection rights holder.

ApeFax may update this DMCA Policy. Material changes will be announced on the site at least seven days before they take effect, unless an immediate change is reasonably necessary for law, security, fraud prevention, or protection of the service.
